Since its WTO membership in 2005, India is moving very rapidly into the new‘Competitive Global Model’ which heavily relies upon intellectual property rights (IPR). Traditionally, India has been quite strong in its scientific talent and workforce and also, process-based technologies. WTO membership has opened up many new opportunities for India to move quickly into the ‘innovation-based strategies, even in most difficult Research and Development (R&D), and investment intense sectors such as pharmaceutical and bio-technologies. The strengths in chemistry, natural products, agricultural bio-technologies, bulk drug manufacturing, clinical patient base and Indian medicines provide sufficient incentives for India to be successful in these new found opportunities and challenges.

Patenting and licensing biomedical technologies facilitate and attract investments by commercial partners for further research and commercial development of new products that can penetrate global markets creating wealth for the country. Both the United States (US) and Western Europe have successfully adopted this model for many years prospering in these technologies. This has also led to many successful and blockbuster preventive, diagnostic, or therapeutic products.

A patent is necessary to encourage a commercial partner to keep important materials or products available for research use. Licensing products and technology platforms is an integral part of many biotechnology and investment companies. With the explosion of start-up companies, ‘In–Licensing’ of early stage and matured biomedical technologies will place India in a highly competitive advantage in the global market while it builds its own IP portfolios. India’s success depends on the effective utilization of this opportunity in these highly dynamic and growing biomedical areas. Commercial positioning using an ‘In Licensing’ route should be critically viewed as an opportunity. However, there are many important legal, business, and scientific considerations in developing successful licensing agreements. The overall objective of this workshop is to provide a roadmap on these new emerging opportunities and understanding the processes involved.
